Terms & Conditions

1. Agreement to Terms

By downloading, installing, or using Tempo (the "App"), you agree to be bound by these Terms & Conditions. If you do not agree to these terms, do not use the App.

2. License to Use

We grant you a limited, non-exclusive, non-transferable, revocable license to use Tempo for your personal, non-commercial use on devices that you own or control. You may not:

  • Copy, modify, distribute, sell, or lease any part of the App
  • Reverse-engineer, decompile, or attempt to extract the source code
  • Use the App for any illegal or unauthorized purpose
  • Interfere with or disrupt the integrity or performance of the App

3. Intellectual Property

Tempo and all associated content, including but not limited to text, graphics, logos, icons, sound files, and software, are the property of MAD Software and are protected by copyright and other intellectual property laws. You may not use our trademarks without prior written permission.

4. Accounts and User Content

Tempo does not currently require an account. If optional account features are introduced later, you will be able to use the core local timer without signing up. Any workout routines, settings, or preferences you create within Tempo are stored locally on your device unless you explicitly choose to use a future account or sync feature. You retain full ownership of this content.

5. Health and Fitness Disclaimer

Tempo is a general-purpose interval timer and is not a medical device. It is not intended to diagnose, treat, cure, or prevent any disease or health condition. You should consult a physician before beginning any exercise program, especially if you have any pre-existing health conditions. Use the App at your own risk.

6. App Updates

Tempo may check a web API endpoint for mobile version policy when an internet connection is available. If you are offline, the app skips this check so workouts remain available. If the app can reach the endpoint and your installed build is below the minimum supported version, we may require you to update the App before continuing. This helps us address security, compatibility, and critical bug fixes.

7. Disclaimer of Warranties

Tempo is provided "as is" and "as available" without warranties of any kind, either express or implied. To the fullest extent permitted by law, we disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, timely, secure, or error-free.

8. Limitation of Liability

To the maximum extent permitted by applicable law, MAD Software and its developers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of (or inability to access or use) the App.

9. Indemnification

You agree to indemnify and hold harmless MAD Software and its developers from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your use of the App, your violation of these Terms, or your violation of any rights of another.

10. Termination

We may terminate or suspend your access to the App at any time, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the App will immediately cease.

11. Governing Law

These Terms shall be governed and construed in accordance with the laws of the jurisdiction in which MAD Software is established, without regard to its conflict of law provisions. Any dispute arising from these Terms shall be resolved in the courts of that jurisdiction.

12. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice before any new terms take effect. What constitutes a material change will be determined at our sole discretion.
